Intoxicated man gets aggressive when woman in parking lot doesn’t have cigarette

ST. GEORGE – When a woman in a flower shop parking lot didn’t have a cigarette to give an intoxicated man Wednesday afternoon, the man allegedly became upset and began hitting the windshield of her car, subsequently leading to his arrest.

Officers responded to a report of a disorderly person in the parking lot of The Flower Market located at 64 N. 800 East in St. George, according to a probable cause statement filed by the St. George Police Department in support of the arrest.

Witnesses told police the disorderly male was hitting the windshield of a vehicle while calling the female occupant a “fu—– bi— “because she did not have a cigarette to give him,” the statement said.

The woman’s husband came outside of the store, confronted the man and a physical altercation was about to ensue, the statement said, but officers arrived on scene.

When officers spoke with the man, identified as 46-year-old Jared Dean Levering, they smelled the odor of alcohol coming from his breath.

“This was the third time we dealt with Jared that day,” the arresting officer wrote in the statement. “Jared’s speech was loud and slurred.”

Levering agreed to blow into a portable breath test, according to the statement, and the result showed he had a .189 blood alcohol content. He was then placed under arrest.

Levering continued “yelling extremely loud” and using profanities, the statement said.

“While I was trying to put Jared’s seatbelt on,” the arresting officer wrote, “he spit on me hitting me in the face with his saliva.”

Levering was transported to the Washington County Purgatory Correctional Facility where he was booked and charged with a class A misdemeanor for spitting on the officer and two class C misdemeanors for disorderly conduct and intoxication.

His court arraignment is scheduled for Thursday afternoon in 5th District Court.

Persons arrested or charged are presumed innocent until found guilty in a court of law or as otherwise decided by a trier-of-fact.
